2.1 You must be at least twenty (20) years old (the legal age of majority in Thailand) or have obtained explicit parental/legal guardian consent, and be legally capable of entering into binding contracts under Thai law to use this Website.

3. Intellectual Property Rights

4. Orders and Contract Formation

4.1 All orders placed through the Website are subject to acceptance by KENS Apothecary. In compliance with applicable consumer protection laws, we reserve the right to reject or cancel any order prior to dispatch for legitimate reasons, including but not limited to product unavailability, clear pricing errors, payment processing failures, or suspected fraudulent activity.

4.2 Upon placing an order, you will receive an automated acknowledgment by email. This acknowledgment does not constitute formal acceptance of your order. A binding contract is formed only when we confirm acceptance and dispatch the products to you.

5. Pricing and Payment

5.1 All prices displayed on the Website are in Thai Baht (THB) and are inclusive of applicable Value Added Tax (VAT), unless explicitly stated otherwise.

5.2 KENS Apothecary reserves the right to modify product prices at any time without prior notice. The price charged will be the price displayed and in effect at the exact time of order placement.

5.3 Payment must be made in full at the time of purchase using the payment methods authorized on the Website. By submitting an order, you represent and warrant that you are legally authorized to use the chosen payment method.

6. Shipping & Delivery

6.1 All deliveries within Thailand are handled by our designated third-party courier service providers as detailed during the checkout process.

7. Statutory Right of Return (7-Day Cooling-Off Period)

7.1 In accordance with the Direct Sales and Direct Marketing Act B.E. 2545, you have a statutory right to terminate the purchase contract and return your product(s) for a full refund within seven (7) days from the date you receive the goods.

7.2 To qualify for a return under this statutory cooling-off period, products must be returned in their original, unopened, and unused condition, accompanied by all original packaging and proof of purchase.

8. Limitation of Liability

8.1 To the maximum extent permitted under the Thai Unfair Contract Terms Act B.E. 2540, KENS Apothecary shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Website.

8.2 Our total liability for direct damages arising from any product purchased on this Website shall be limited to the actual purchase price paid by you for that specific product.

8.3 Nothing in these Terms shall exclude or limit our liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be legally excluded or restricted under applicable Thai law.

10. Force Majeure

10.1 KENS Apothecary shall not be held liable or responsible for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, acts of God, strikes, lockouts, industrial disputes, acts of terrorism, civil unrest, governmental restrictions, epidemics, pandemics, or widespread failures of public telecommunication networks.

11. Governing Language

11.1 These Terms may be provided in both English and Thai. In the event of any discrepancy, ambiguity, or conflict of interpretation between the English version and the Thai version, the Thai version shall prevail for consumer transactions to the extent required by Thai consumer protection laws.

12. Governing Law and Jurisdiction

12.1 These Terms shall be governed by, construed, and enforced in accordance with the laws of the Kingdom of Thailand.

12.2 Any dispute arising out of or in connection with these Terms, including the purchase of any products, shall be subject to the exclusive jurisdiction of the competent courts of Thailand.
